By accessing and using Vultrik ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Vultrik is a security scanning platform that provides:

• Automated vulnerability scanning of websites and web applications
• Security assessment reports and recommendations
• Continuous monitoring and alerting services
• Integration capabilities with third-party security tools
• API access for programmatic scanning (paid plans)

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Termination

You may terminate your account at any time through your account settings. We may terminate or suspend your account for violations of these terms.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, threatening, or offensive content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service for any fraudulent or illegal purpose
• Scan domains you do not own or have permission to scan
• Excessively burden our infrastructure through automated means

5. Scanning Permissions

By adding a domain to Vultrik for scanning, you represent and warrant that:

• You own or have legal authority to scan the domain
• The domain is publicly accessible and not behind authentication
• You have permission to perform security assessments on the domain
• You understand that scanning may temporarily impact site performance

Vultrik will not scan private, internal, or authenticated domains.

6. Service Availability

6.1 Uptime Commitment

While we strive for high availability, we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Maintenance and upgrades
• Technical issues
• Force majeure events
• Third-party service disruptions

6.2 Free Plan Limitations

The free plan is provided "as is" without service level agreements or uptime guarantees.

7. Billing and Payment

7.1 Payment Terms

For paid plans:

• Payments are processed through secure third-party providers
• Subscription fees are billed in advance
• You are responsible for all applicable taxes
• Failed payments may result in service suspension

7.2 Refunds

We offer a 30-day money-back guarantee for paid plans. Refund requests must be made within 30 days of purchase.

7.3 Plan Changes

You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.

8. Intellectual Property

8.1 Our Content

The Service and its original content, features, and functionality are owned by Vultrik and are protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain ownership of scan data and reports generated for your domains. You grant us a license to process and store this data for service delivery.

8.3 License Grant

We grant you a limited, non-exclusive, non-transferable license to use the Service subject to these terms.

9. Data Privacy and Security

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms.

We implement security measures to protect your data, but you acknowledge that no system is 100% secure.

10. Disclaimers

10.1 Service Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of scan results
• Uninterrupted or error-free operation
• Security or protection against all threats

10.2 Security Scanning Limitations

Security scanning cannot detect all vulnerabilities. False positives and false negatives may occur. Vultrik does not guarantee the discovery of all security issues.

11. Limitation of Liability

To the maximum extent permitted by law, Vultrik shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claim related to the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Vultrik, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Service
• Your violation of these terms
• Your violation of any third-party rights
• Any content or domains you submit for scanning

13. Termination

13.1 Termination by You

You may terminate your account at any time through your account settings.

13.2 Termination by Us

We may terminate or suspend your account immediately for violations of these terms.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable period.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the European Union, without regard to conflict of law provisions.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the European Court of Arbitration.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or platform notification.

Your continued use of the Service after changes become effective constitutes acceptance of the modified terms.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Vultrik regarding the Service.
